AG Hardy Myers' Position Affirmed By Today's Ruling Of 9th Circuit Court Of Appeals

Statement from Attorney General Hardy Myers

"Today's ruling by the Ninth Circuit Court of Appeals affirms my steadfast position that the states have independent authority to determine the scope of legitimate medical practice.

"The court's statement is clear, "We hold that the Ashcroft Directive is unlawful and unenforceable because it violates the plain language of the CSA [Controlled Substances Act], contravenes Congress' express legislative intent, and oversteps the bounds of the Attorney General's statutory authority."

"Today's decision is a clear victory for Oregon, and for every other state, ensuring their role as primary medical policymakers."
